Apply for benefits under the Asylum Seekers Benefits Act

The following benefits are possible:

  • Basic benefits to cover the necessary requirements for food, accommodation, heating, clothing, healthcare and household consumer goods as well as to cover personal needs in daily life
  • Benefits in the event of illness, pregnancy and childbirth
  • other benefits

You receive these benefits in the form of benefits in kind and/or cash benefits or via a payment card.

There may be restrictions, for example if you

  • are obliged to leave the country and have not left Germany for reasons for which you are responsible, despite a fixed departure date and a fixed possibility of leaving the country
  • are obliged to leave the country or have been tolerated and have entered the country in order to receive benefits under the Asylum Seekers Benefits Act
  • are obliged to leave the country or have been tolerated and for reasons for which you are responsible, measures to terminate your stay cannot be enforced
  • are in possession of a residence permit or have submitted a subsequent or second application for asylum and do not fulfil certain obligations to cooperate in the asylum procedure
  • deliberately or negligently fail to declare existing assets or fail to report changes in your financial circumstances immediately
  • are in possession of a residence permit or are obliged to leave the country and another country is responsible for carrying out your asylum procedure in accordance with the Dublin III Regulation and your deportation to this country has been ordered by the Federal Office for Migration and Refugees
  • refuse a job opportunity or a refugee integration measure without justification despite being able to work.

The entitlement to benefits ends

  • upon departure or
  • at the end of the month in which the Condition for benefits ceases to apply.

Responsible authority

during the initial reception period:

  • the regional council responsible for your initial reception centre

during temporary accommodation/final accommodation:

  • if you live in an urban district: the city administration
  • otherwise: the district office responsible for your place of residence

Details

Prerequisite

You are a foreigner or reside in Germany and fulfil one of the following requirements:

  • You have a residence permit in accordance with the Asylum Act.
  • You have applied for asylum, but no proof of arrival has yet been issued.
  • You wish to enter the country via an airport and you are not or not yet authorised to enter the country.
  • You have one of the residence permits expressly mentioned in § 1 Paragraph 1 Number 3 of the Asylum Seekers Benefits Act.
  • You have a tolerated stay permit in accordance with § 60a of the Residence Act (AufenthG).
  • You are obliged to leave the country, even if a deportation order is not yet or no longer enforceable.
  • You are the husband/wife, life partner or minor child of the above-mentioned persons, but do not fulfil the above-mentioned requirements yourself.
  • You have submitted a subsequent or second application in accordance with § 71 or § 71a of the Asylum Act (AsylG).
  • You have a residence permit in accordance with Section 24 of the Residence Act or a fictitious certificate in accordance with Section 81 (5) in conjunction with (3) or (4) of the Residence Act, which was granted or issued after 24 February 2022 and before 1 June 2022, and you have undergone an identification procedure, if provided for.

You must also use up any disposable income and assets above the statutory allowance before you can claim benefits.

Procedure

As a rule, you must first contact the responsible office and submit an application there.

They will check whether the conditions for benefits are met.

If you are entitled to benefits, you will receive benefits in kind and/or cash benefits or benefits via a payment card.

Deadlines

You will only receive benefits after the competent office has determined that the conditions for benefits have been met. You should therefore contact the office responsible for you as soon as possible.

Required documents

If possible, you should present the following documents:

  • valid passport and proof of legal immigration status (e.g. permit, toleration)
  • Proof of any income at the time of application (e.g. payslip)
  • Proof of assets

The competent authority may request further documents. You must state all facts that are relevant to the granting of asylum seeker benefits. As soon as any changes occur, you must inform the responsible office.
